Gang raped girl was ‘so ashamed’ ?

A teen allegedly raped by three older boys told friends she had “f---ed up” and was “so ashamed” after rumours about a foursome spread through the school, a jury has heard.
And two fellow students said the girl seemed “fine” or “normal” at the end of the school day, within hours of the alleged rape.


The witnesses, giving evidence in the ACT Supreme Court trial of the men accused of the rape, also suggested the complainant exaggerated the effects of the cannabis she smoked on the day.

The alleged victim has said she was heavily intoxicated by the drug at the time.

The accused men cannot be named and for the sake of clarity The Canberra Times will refer to them – aged 18, 18 and 17 at the time – as persons A, B and C.

The trio has pleaded not guilty to charges of having sexual intercourse with the then-16-year-old and using a child to produce pornography.

The latter charges relate to a 19-second mobile phone recording of the alleged victim having sexual intercourse with A and B, sitting on top of the then-teens.

The males can be seen making hand gestures and smiling at the camera, while the girl’s face cannot be seen through the brief video.

The case hinges on whether the sex was consensual, and defence lawyers have argued the girl falsely accused their clients after the video was circulated throughout the school community.

During cross-examination she admitted lying on occasion if it suited her, and adding details to make a story believable.

She has maintained she verbally resisted the sex at the outset but became “a rag doll”, was scared of getting hurt and never consented to intercourse.

A former friend of the complainant, who described Person A as her “closest friend” at the time and was later involved in a playground fight with the alleged victim, said the girl seemed “fine” during a conversation in the hours after the incident.

She rejected a suggestion from prosecutor Margaret Jones that the conversation never took place.

The same witness said when she confronted the defendant about the video she began crying, replied “I f---ed up” and expressed concerns about cheating on her boyfriend.
